Terms of Use

1. Definitions

• “Tarlan,” “we,” “us,” “our” refers to the entity operating the Tarlan platform, currently Abyarth Kumar Behera operating under the trade name “Tarlan.” Upon incorporation, this will be updated to the registered company.
• “User,” “you,” “your” refers to any individual who creates an account on or uses the Platform.
• “Platform” refers to the Tarlan website, applications, AI-powered tools, and all associated services.
• “Services” refers to all features and functionality provided through the Platform, including resume processing, job matching, resume customization, profile management, employer connections, and related communications.
• “User Content” refers to all data, files, information, and materials you provide to the Platform, including your resume, profile information, conversation responses, edits, and feedback.
• “AI-Generated Content” refers to all data, analyses, assessments, profile refinements, and customized resume content generated by our AI systems based on your User Content.
• “Employer” refers to any company, recruiter, hiring manager, or other entity or individual seeking to hire or engage candidates.

2. Eligibility

The Platform is intended for individuals who are 18 years of age or older and are seeking employment or career opportunities for themselves. By creating an account, you represent and warrant that:

• You are at least 18 years old.
• You are using the Platform for your own personal job search and career development.
• You have the legal capacity to enter into these Terms.
• All information you provide is accurate, current, and complete.

We reserve the right to suspend or terminate accounts that do not meet these eligibility requirements.

3. Your Account

To use the Platform, you must create an account by authenticating through Google or LinkedIn. You are responsible for:

• Maintaining the security of your account credentials and authentication methods.
• All activity that occurs under your account.
• Notifying us promptly if you become aware of any unauthorised access to your account.

You may not share your account with others, create multiple accounts, or transfer your account to another person. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Our Services

Tarlan provides an AI-powered career discovery platform. Our Services include, but are not limited to:

• Processing your resume and building a structured professional profile using AI.
• Conducting AI-powered onboarding interviews and job-specific Q&A sessions to understand your career goals and preferences.
• Matching you with relevant job opportunities based on your profile, skills, experience, and preferences.
• Generating personalised job analyses, fit assessments, and gap evaluations.
• Creating customised resumes tailored to specific job descriptions.
• Refining and enriching your professional profile based on your interactions with the Platform.
• Sharing your professional profile and contact information with employers and recruiters to facilitate recruitment matches and introductions.
• Sending personalised notifications about new job matches and opportunities.

We may modify, expand, or discontinue any aspect of the Services at any time. We will provide reasonable notice of material changes where practicable.

5. Your Content

5.1 Ownership

You retain ownership of all User Content you provide to the Platform, including your resume, profile information, and conversation responses. Nothing in these Terms transfers ownership of your content to Tarlan.

5.2 Licence Grant

By uploading or providing User Content to the Platform, you grant Tarlan a worldwide, non-exclusive, royalty-free, sublicensable licence to use, process, store, modify, adapt, display, and distribute your User Content for the following purposes:

• Providing and improving the Services, including AI-powered resume parsing, profile refinement, job matching, and resume customization.
• Sharing your profile and contact information with employers and recruiters as described in our Privacy Policy.
• Generating AI-Generated Content based on your User Content.
• Displaying your content within the Platform (e.g., your profile, match results, customized resumes).
• Improving our AI models, matching algorithms, and platform functionality using aggregated and anonymised data derived from User Content.

This licence terminates with respect to our own future use of your User Content upon account deletion, and your User Content is deleted from our systems in accordance with our Privacy Policy. This does not retroactively affect the lawfulness of any disclosure or use of your User Content that occurred before deletion, including our continued use of aggregated or anonymised data derived from your User Content, which does not identify you.

5.3 Your Responsibilities

You represent and warrant that:

• All User Content you provide is accurate, truthful, and not misleading.
• You have the right to provide the User Content and grant the licence described above.
• Your User Content does not infringe the intellectual property or other rights of any third party.
• Your resume and profile information relate to your own professional background and experience. You may not upload resumes or create profiles on behalf of other individuals.

6. AI-Generated Content

6.1 Nature of AI Output

The Platform uses artificial intelligence to generate content including structured profiles, match assessments, fit analyses, gap evaluations, profile refinements, and customised resume content. You acknowledge and agree that:

• AI-Generated Content is produced by automated systems and may contain errors, inaccuracies, or omissions.
• AI-Generated Content is provided as a tool to assist you. It is not professional career advice, legal advice, or a guarantee of employment outcomes.
• You are solely responsible for reviewing, verifying, and approving all AI-Generated Content before using it, including any customised resume content before downloading or submitting it to employers.
• Tarlan does not guarantee that AI-Generated Content will be complete, accurate, suitable for any particular purpose, or free from bias.

6.2 Profile Modifications

Our AI may modify your profile information, including rewriting achievement descriptions, adding skills, or reorganising content, based on information you provide through conversations, edits, and Q&A sessions. All such modifications are tracked in a version history, and you can revert any change at any time. By using the Platform, you consent to these automated profile modifications, subject to your ability to review and revert them.

6.3 Customised Resumes

When you use our resume customization feature, the AI generates a modified version of your resume tailored to a specific job description. You review every proposed change and choose whether to accept, edit, or reject each modification before the final resume is generated. The final customised resume is your document - you are responsible for its accuracy and content.

7. Employer Connections

Tarlan connects candidates with employers and recruiters. You acknowledge and agree that:

• Tarlan shares your professional profile and contact information with employers and recruiters as described in our Privacy Policy. You can opt out of profile sharing at any time by emailing hello@tarlan.ai.
• Tarlan does not guarantee that employers will view your profile, contact you, offer you an interview, or extend an offer of employment.
• Tarlan is not a party to any employment relationship, contract, or agreement between you and any employer. Any hiring decision is made solely by the employer.
• Tarlan does not endorse, verify, or take responsibility for any employer, job listing, or employment opportunity displayed on the Platform.
• You are responsible for conducting your own due diligence on any employer or opportunity before engaging.

Tarlan may contact you directly, or facilitate introductions between you and employers, for opportunities that match your profile. You can opt out of direct outreach at any time by emailing hello@tarlan.ai.

8. Prohibited Uses

You agree not to:

• Provide false, misleading, or fraudulent information, including fabricated resumes or inflated credentials.
• Create an account or upload a resume on behalf of another person.
• Use the Platform for any purpose other than your own personal job search and career development.
• Attempt to access, scrape, harvest, or extract data from the Platform using automated means (bots, crawlers, scrapers) or any method not authorised by us.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or models underlying the Platform or our AI systems.
• Use the Platform to harass, spam, or send unsolicited communications to employers or other users.
• Interfere with or disrupt the Platform’s infrastructure, security, or performance.
• Use the Platform in violation of any applicable law or regulation.
• Circumvent or attempt to circumvent any access controls, security features, or usage limitations.
• Upload or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Use the AI-Generated Content or any data obtained from the Platform to build competing products or services.

We reserve the right to suspend or terminate your account immediately if we reasonably believe you have engaged in any prohibited use.

9. Intellectual Property

9.1 Tarlan’s IP

The Platform, including its design, user interface, software, AI models, algorithms, matching logic, data structures, source code, documentation, branding, logos, and all related intellectual property, is owned by Tarlan and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in Tarlan’s intellectual property, except the limited right to use the Platform in accordance with these Terms.

9.2 Feedback

If you provide us with suggestions, ideas, feedback, or recommendations about the Platform (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, and incorporate the Feedback into our products and services without any obligation to you.

10. Disclaimers

The Platform and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Tarlan expressly disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Without limiting the foregoing, Tarlan does not warrant or guarantee that:

• The Platform will be uninterrupted, error-free, secure, or free from bugs or viruses.
• AI-Generated Content will be accurate, complete, or suitable for your needs.
• Job matches or recommendations will result in employment interviews or offers.
• Employer information or job listings displayed on the Platform are accurate, current, or complete.
• The Platform will meet your specific requirements or expectations.

You use the Platform and rely on AI-Generated Content at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Tarlan, its founders, officers, employees, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, employment opportunities, or other intangible losses, arising out of or in connection with your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

In no event shall Tarlan’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform exceed the total fees, if any, paid by you to Tarlan in the twelve (12) months preceding the event giving rise to the claim. If you have not paid any fees to Tarlan, our maximum aggregate liability shall be limited to INR 1,000 (Indian Rupees One Thousand).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tarlan, its founders, officers, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Platform or Services.
• Your breach of these Terms.
• Your User Content, including any claim that your content infringes the rights of a third party.
• Any inaccuracy in the information you provide, including your resume and profile data.
• Your interactions with any employer or third party through the Platform.

13. Termination

13.1 By You

You may terminate your account at any time by requesting account deletion through your account settings or by contacting us at hello@tarlan.ai. Upon deletion, your User Content and AI-Generated Content will be deleted in accordance with our Privacy Policy.

13.2 By Us

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe that:

• You have violated these Terms.
• Your account has been used for prohibited purposes.
• Your continued use poses a risk to the Platform, other users, or third parties.
• It is required by law.

Where practicable, we will provide notice and an opportunity to address the issue before termination, except in cases of serious or repeated violations.

13.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. The following provisions survive termination: Section 5.2 (Licence Grant, with respect to aggregated and anonymised data only), Section 9 (Intellectual Property), Section 10 (Disclaimers), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 16 (Governing Law), and any other provisions that by their nature should survive.

14. Changes to These Terms

We may update these Terms from time to time. When we make changes:

• We will notify you by email and/or through a prominent notice on the Platform.
• The "Last Updated" date will be revised.

By continuing to use the Platform after updated Terms take effect, you agree to the updated Terms. If you do not agree to the changes, you should stop using the Platform and delete your account.

15. Third-Party Services and Links

The Platform may contain links to third-party websites, job listings, employer pages, and external services. These are provided for your convenience and do not imply endorsement. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party service. Your interactions with third parties, including employers, are solely between you and them.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

For users in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your jurisdiction, including your right to bring proceedings in local courts.

17. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tarlan regarding the Platform.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
• Assignment: You may not assign or transfer your rights under these Terms. Tarlan may assign its rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.
• No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Tarlan.
• Force Majeure: Tarlan shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, government actions, internet or infrastructure failures, or third-party service disruptions.
